Acceptable Use Policy
Your use of the SYNQY Enhanced Product Listing Ad Network™ or the SYNQY Persuasion Engine™ Platform, any SYNQY service or any SYNQY website is subject to this Acceptable Use Policy. SYNQY reserves the right to terminate your account and cease all services if you are found to be in violation of this policy. SYNQY shall determine, in its sole discretion, what content or uses may violate this policy. We may change this policy at any time without notice to you. It is your responsibility to keep up to date with and strictly adhere to this policy.
Prohibited Content
The Content displayed and/or processed across the SYNQY Enhanced Product Listing Ad Network™, the SYNQY Persuasion Engine Platform or other web site utilizing the SYNQY Service shall not contain any of the following types of content, the determination of which shall be made by SYNQY in its sole discretion:
- Content that infringes a third party’s intellectual property or other proprietary rights (e.g. copyright, trade secrets) under applicable law;
- Content that is defamatory or contains defamatory materials;
- False or deceptive content or that which contains false or deceptive materials;
- Obscene or pornographic material;
- Excessively profane and/or sexually explicit content;
- Content that promotes or contains violence or the use of firearms, except we may allow a property containing violence or the use of firearms if it is labeled with the appropriate age and audience restrictions;
- Hate-related content;
- Content advocating or displaying racial, ethnic or religious intolerance or discrimination;
- Content that is or threatens to be invasive to another’s privacy, and/or is abusive or harassing;
- Content intended to advocate or advance computer hacking or cracking, or software misuse or pirating;
- Gambling content;
- Other illegal activity, including without limitation matters pertaining to narcotics or other controlled substances (or related paraphernalia) or counterfeit goods;
- Phishing content;
- Malicious content;
- Other material, products or services that violate or encourage conduct that would violate any criminal laws, any other applicable laws, or any third-party rights;
Prohibited Actions
You agree not to, and not to allow third parties (including your advertisers or end users) to use the SYNQY Enhanced Product Listing Ad Network or the SYNQY Persuasion Engine Platform:
- to violate, or encourage the violation of, the legal rights of others (for example, allowing end users to infringe or misappropriate the intellectual property rights of others in violation of the Digital Millennium Copyright Act, the General Data Protection Regulation or the California Consumer Privacy Act);
- to engage in, promote or encourage illegal activity;
- for any unlawful, invasive, infringing, defamatory or fraudulent purpose (for example, phishing, creating a pyramid scheme or mirroring a website);
- to intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature;
- to interfere with the use of the SYNQY Enhanced Product Listing Ad Network, the SYNQY Persuasion Engine Platform or any SYNQY Persuasion Engine applications or code, or any related equipment, by customers, authorized resellers, or other authorized users;
- to disable, interfere with or circumvent any aspect of the SYNQY Persuasion Engine Platform or SYNQY Enhanced Product Listing Ad Network;
- to generate, distribute, publish or facilitate unsolicited mass email, promotions, advertisings or other solicitations (“spam”);
- to falsify registration information;
- to alter an Ad or Ad Response in any way;
- to serve any Ad over or under another advertisement;
- to display or otherwise use our (or our affiliates’) trademarks, service marks or logos of SYNQY branded content except as expressly permitted in writing or as expressly permitted under the Publisher Agreement
- to sell, resell, redistribute, sublicense or transfer any Content or any application that incorporates or displays any Content;
- to attempt to artificially increase Advertising Fees or inflate Qualifying Events on behalf of yourself or another through the use of any automated or manual means. You will not authorize, assist or encourage any other person or entity to do the same;
- to engage in any deceptive practices when marketing and displaying Ads
- to engage in a manner intended to avoid incurring fees from valid Qualifying Events
